Frequently Asked Questions

Everything you need to know about Ontario land transfer tax before your closing day.

Land Transfer Tax is a provincial tax payable by the buyer when title to real property is transferred in Ontario. It is based on the purchase price of the property and is collected at closing by your lawyer.

Ontario LTT uses a marginal bracket system, similar to income tax:

• 0.5% on the first $55,000

• 1.0% on $55,001 to $250,000

• 1.5% on $250,001 to $400,000

• 2.0% on $400,001 to $2,000,000

• 2.5% on amounts over $2,000,000

Toronto imposes its own Municipal Land Transfer Tax on top of the provincial LTT for properties within City of Toronto boundaries. The brackets mirror the provincial rates, meaning buyers in Toronto effectively pay double the land transfer tax compared to the rest of Ontario.

To qualify for the Ontario First-Time Home Buyer LTT Rebate you must:

• Be a Canadian citizen or permanent resident

• Have never owned a home anywhere in the world

• Occupy the home as your principal residence within 9 months of closing

The maximum Ontario rebate is $4,000 (covering the full LTT on a home priced at $368,333 or less). Toronto offers an additional rebate up to $4,475 for homes within city limits.

Ontario's rebate eliminates LTT up to a maximum of $4,000. If you are also buying in Toronto, the Toronto MLTT rebate adds up to $4,475, for a combined maximum savings of $8,475. For properties priced above the eligible thresholds, the rebate is still capped at these maximums.

The NRST is a 25% tax on the purchase price of certain residential properties in Ontario purchased by foreign nationals, foreign corporations, or taxable trustees. It applies on top of LTT and MLTT and is intended to discourage speculation by non-residents.

Yes, refunds may be available in certain circumstances, including:

• Becoming a Canadian citizen or permanent resident within 4 years of purchase

• Nominees under a provincial immigrant investor program who become permanent residents

• Protected persons (refugees) confirmed within 4 years of purchase

Consult a real estate lawyer to determine your eligibility for a refund.

LTT is paid on the closing day of your real estate transaction. Your real estate lawyer will calculate the exact amount, collect it from you, and remit it to the province (and City of Toronto, if applicable) as part of the closing process.

Several other exemptions may reduce or eliminate LTT:

• Transfers between spouses (certain conditions apply)

• Certain family farm transfers

• Transfers involving newly constructed housing (partial exclusions)

• Transfers pursuant to a court order

The rules are complex and fact-specific. Always speak with a real estate lawyer to determine whether an exemption applies to your situation.
